Justin Fairfax Faces Potential Incarceration in Upcoming Court Hearing Amid Eviction and Tragic Family Incident

Stunning court documents have surfaced revealing that former Virginia Lt. Gov. Justin Fairfax was on the verge of eviction from his family residence and potentially facing jail time mere days before the tragic murder-suicide involving his wife.

The 47-year-old Democrat had been instructed to vacate the $910,000 Annandale home he shared with his wife, Cerina, and their two teenage children by April 30, according to a court mandate issued last month.

Additionally, a three-day hearing was scheduled to begin on April 21 regarding their divorce proceedings, primarily to address how their assets would be split, as indicated by court records.

Cerina had filed a motion on April 3, accusing Justin of contempt for allegedly failing to meet a March 25 court-ordered deadline to pay her $1,865 for household expenses.

The motion suggested that the judge should consider incarcerating Justin until he fulfilled his financial obligations, as outlined in the documents submitted by Cerina’s attorney, Amy Spain. “You may be found in Contempt of Court for your failure to abide by the terms of this Court’s Orders,” the filing warned. “The potential punishment may include, but is not limited to, your imprisonment until you come into compliance with this Court’s Orders or present a reasonable plan to do so.”

The wife wanted her newest contempt motion to be addressed at next week’s hearing.

On March 30, Judge Timothy McEvoy issued a blistering ruling laying out Cerina’s claims that Justin was drinking, smoking and reclusive in their home and nearly completely absent from the lives of their kids – Carys, 14, and Cameron, 16.

McEvoy ordered Justin to move out of the house by April 30 and cut his visitation with the kids down to a few hours on Wednesdays and Saturdays. The judge also ordered Justin to take alcohol tests an hour before he saw the kids.

McEvoy attributed Justin’s mental health decline to two pivotal moments, his failure to win the Virginia attorney general’s race in 2013, and when sexual assault allegations surfaced against him by two women in 2019.

Justin fatally shot Cerina and himself while their kids were at home. Their son made a frantic 911 call after finding his mom’s bloodied body.
