PLYMOUTH, Mass. — Attorneys representing the lone holdout juror in the mistrial involving Massachusetts mother Lindsay Clancy say they intend to file a bar complaint against Clancy’s defense attorney, citing his treatment of their client.
“I can tell you, we’re gonna file a bar complaint,” attorney Tyler Cox told Fox News host Sean Hannity during an appearance on his show Tuesday night.
Kevin Reddington, a veteran Massachusetts defense attorney, said in court Tuesday that he was tired of being accused of “persecuting” the holdout juror. The juror was the only man among the 12 panelists who favored finding Clancy guilty.

“He said that all he’s done is file a motion,” Cox said. “Well, even if you take that as true, which it obviously isn’t, the motion that he filed was unprecedented. You don’t attack jurors this way, you don’t single them out, and we’re going to file a bar complaint.”

Plymouth County prosecutors have separately requested a gag order, accusing Reddington of contributing to the public disclosure of the holdout juror’s identity. They also said his actions deprived the other jurors of their time and Clancy of a possible acquittal.

“In the same instances, defense counsel praised the foreperson as courageous and the jurors, minus one, were so attentive, so beautiful, so wonderful,” Assistant Plymouth County District Attorneys Jennifer Sprague and Shanan Buckingham wrote.

“Under the caselaw and ethical rules, limitations on lawyers’ speech is aimed at two principal evils: comments that are likely to influence the actual outcome of the trial and comments that are likely to prejudice the jury venire,” the prosecutors added.
Reddington has referred to the holdout juror as “the obstructionist” and, earlier this week, exchanged sharp words with Edward Paltzik, another attorney representing the juror.

Clancy is scheduled to return to court Nov. 2 for a motion hearing. The schedule for a possible retrial remains uncertain, and no new trial date has been set after both sides told Judge William Sullivan they needed additional time.
