Lindsay Clancy holdout juror’s lawyers say they plan bar complaint against Reddington

PLYMOUTH, Mass. — Defense attorney Kevin Reddington is rejecting the suggestion that he adopted a new courtroom strategy Tuesday by questioning whether prosecutors proved Lindsay Clancy killed her three children. He says challenging the strength of the Commonwealth’s case has been central to his defense from the start.

In an interview with Fox News contributor Billy Bush for his “Hot Mics” podcast, Reddington described the investigation into Clancy as “horrific” and “atrocious.” His comments followed arguments that prosecutors failed to present sufficient evidence to establish guilt beyond a reasonable doubt.

“That’s exactly what I was saying,” Reddington told Bush after Clancy returned to court for the first time since her mistrial. “I’ve been arguing that from the very beginning. I argued it in a closing argument to the jury. I argued in our motions.”

Reddington was presenting a Rule 25 motion seeking a required finding of not guilty. The filing argues that the evidence introduced during trial was inadequate to legally support a conviction.

“Where’s the evidence that she did this?” Reddington asked Judge William Sullivan on Tuesday. He then pointed to what he characterized as gaps in the prosecution’s case, along with statements he described as unreliable. “Where is the evidence she did this?”

The motion drew national attention, but Sullivan issued no rulings Tuesday. Instead, he postponed arguments on several other pending motions until Nov. 2, leaving observers, including Bush, frustrated that the hearing produced few immediate answers.

“He didn’t get any answers on the insufficiency of evidence,” Bush told News Outlet Wednesday. “He wanted, immediately, her to be declared not criminally responsible because of that. I think that was a stretch. He probably knew it. He brought in his double jeopardy expert, Martin Weinberg. That was punted to Nov. 2. That wasn’t immediately successful. And the alleged juror misconduct, we didn’t get anything on that because Judge Sullivan, Reddington told us, impounded that information. We want to see the jury questionnaire. Everybody wants to see it.”

Sullivan declared a mistrial on Sept. 4, after jurors spent approximately a week deliberating without reaching a unanimous verdict.

Carol Erskine, a retired Massachusetts judge and child welfare advocate who has closely followed the case, said Rule 25 motions are standard courtroom filings but rarely succeed.

“He is arguing that [they] did not prove each and every element as required by law,” she told News Outlet. “I understand why people don’t get this, but he had to argue sufficiency of evidence under Rule 25(b)(2) case law. He told the judge he asked for a Bowden instruction and was denied, which meant he was challenging the poor investigation/search at the home by police. It’s a very nuanced argument.”

Plymouth County prosecutors took a far more dismissive view, calling Reddington’s position “a laughable argument” and urging Sullivan to reject the motion.

Clancy is scheduled to return to court Nov. 2 for a hearing on the outstanding motions. No date has been set for a possible retrial.

As Clancy’s legal future remains unresolved, Reddington has attracted attention of his own outside the courthouse. Bush said the prominent Massachusetts defense attorney frequently interacts with members of the media covering the case and has built a national profile, complete with nicknames such as “Big Red” and “Shreddington.”

“Big Red goes out to the parking lot,” Bush said. “He talks to the different people who are covering this in their own way. He asks them questions about themselves. He sits there in a lawn chair, having coffee and connecting with everybody.”

Bush said Reddington’s supporters include a significant number of women who have been following the case.

“They support Lindsay Clancy,” he said.

“But they love Reddington because he’s the man who’s fighting for her,” he added. “And they’re all seeing him as that guy, ‘Geez, I’d like that man fighting for me someday, if I needed it.'”
