Mamdani’s Pied-à-Terre Tax Moves Forward as Legal Battle Continues

The pause has been put on hold.

Mayor Zohran Mamdani’s troubled rollout of a pied-à-terre tax resumed Thursday after an unexpected appeals court decision temporarily cleared the way for City Hall to move ahead — though the legal battle remains unresolved.

The ruling from the appellate court temporarily suspends a restraining order issued Monday by a lower court, allowing the administration to continue implementing the disputed tax while the full appeals panel reviews the case.

Associate Justice Philip Hom of the Brooklyn Appellate Division signed the order.

In opposition papers filed Thursday, former first deputy mayor Randy Mastro, who represents three city homeowners challenging the rollout, blasted the Mamdani administration’s effort to keep the tax moving as “an astonishing display of chutzpah.”

Mastro argued that the city is “compounding their illegal conduct by going to extraordinary lengths to avoid a three-week pause in their harassment campaign of New York City homeowners,” adding that the surcharge does not need to be invoiced until Nov. 15, 2026, or collected until January.
