Trump asks the Supreme Court to allow him to enforce transgender and nonbinary passport policy

President Donald Trump’s administration requested that the Supreme Court allow it to implement a passport policy that requires transgender and nonbinary individuals to have male or female designations aligning with their birth certificates.

The Justice Department appealed a ruling from a lower court that permitted individuals to use gender markers or an “X” that corresponds with their gender identity.

The government says it can’t be required to use sex designations it considers inaccurate on official identification documents.

Following an executive order by Trump in January, the State Department modified its passport application processing to recognize only “male and female” based on what is described as “an individual’s immutable biological classification.”

Actor Hunter Schafer mentioned in February that her recent passport was issued with a male gender designation, even though her driver’s license and previous passport had female gender markers since her adolescence.

A judge halted the new policy in June after lawsuits from transgender and nonbinary individuals, who argued that some had their applications altered with different designations, while others were apprehensive about applying.

The Trump administration asked the Supreme Court to put the judge’s order on hold while the lawsuit continues to play out.
