Florida hospital patient finally leaves room after 5 months amid legal battle

A Florida hospital has recently withdrawn its legal action against a patient who had steadfastly refused to vacate her hospital room for several months. This comes after the woman finally decided to leave the facility.

Tallahassee Memorial HealthCare (TMH) initially pursued a court order to have the woman removed from the premises. She had overstayed her welcome after being officially discharged in early October. The hospital even went as far as involving the Leon County Sheriff’s Office to assist with her potential removal.

Plans for a court hearing originally set for Monday have now been canceled following the hospital’s decision to dismiss the case voluntarily. According to The Associated Press, Sarah Cannon, a spokesperson for the hospital, confirmed on Monday that the matter is considered resolved since the patient “is no longer at TMH.”

The hospital had stated in its complaint that the woman’s extended occupancy was a drain on resources, diverting staff and keeping a much-needed hospital bed from other patients. Such situations place a strain on healthcare facilities, which must balance patient care with operational needs.

The hospital argued in its complaint that the woman’s continued stay diverted staff and resources from other patients and tied up a needed hospital bed.

“TMH has limited inpatient beds,” the complaint stated. “The defendant’s continued occupancy prevents use of the bed for patients needing acute care.”

According to the filing, she no longer required acute care after a formal discharge order was issued Oct. 6, and staff made repeated efforts to coordinate her departure, including offering transportation and contacting family members.

It is unclear how often hospitals resort to legal action to remove patients who refuse to leave after discharge.
