Matthew Overmyer, 35, the co-owner of O Face Bar in Council Bluffs, was arrested on February 4 and pleaded not guilty to second-degree s*xual abuse and assault with the purpose to conduct s*xual abuse.

A local bar owner once featured on “Bar Rescue” who served 90 days in jail after he pleaded guilty to assault with intent to commit s*xual abuse was back in handcuffs after failing to register as a s*x offender, among other charges in august 2019.

Matthew was arrested in February 2016 and first pled not guilty to counts of assault and second-degree s*xual abuse, but eight months later, he pleaded guilty. Matthew is said to have used drunkenness as a defense in this case.

Matthew Overmyer, 35, co-owner of the O Face Bar in Council Bluffs, was arrested Monday for not reporting to the Residential Treatment Center after getting out of jail on April 4. Overmyer is also charged with escaping custody, as it was not known where he was during the 13 days between prison and his arrest, according to the police report.

Overmyer pleaded guilty to two modified charges of assault with the intent to conduct s*xual abuse with no bodily harm.

“I attacked a woman on February 2, 2016, seizing her arms,” Overmyer told the court. “I did so with the intention of engaging in a s*xual act against her will.”

Overmyer accepted responsibility and took advantage of the chance to move on, according to Fourth District Judge Richard Davidson.
