Disgraced Hollywood producer and convicted sex offender Harvey Weinstein has been reprimanded in jail for allegedly possessing contraband Milk Duds, Variety reports.

Jail officers in Los Angeles found the chocolate-covered caramels on November 10 after Weinstein had a physical meeting with Shawn Burkley, an attorney, and confiscated the candy. The infraction came to light this week after Variety viewed records detailing the incident.

Weinstein reportedly asserted that the Milk Duds were with him when he was extradited to Los Angeles from New York this past summer, according to TMZ.

However, jail authorities had searched Weinstein when he arrived in L.A. and did not have a record of the Milk Duds. In a statement to the magazine through his representative, Weinstein offered an apology.

“This was an innocent misunderstanding,” Weinstein told Variety. “It will not happen again. I have been a model inmate, following the rules and regulations and I am sincerely sorry.”

Lead attorneys for Weinstein also apologized.

“We have been informed about this and are very sorry it happened,” the lawyers, Mark Werksman and Alan Jackson, said in a statement to Variety. “It had not happened before, and never happened since. Harvey has been a model inmate and intends to continue as such.”

Jail authorities reportedly warned that in future lawyer visits with Weinstein, bags and other materials would be searched and if there are additional infractions, Weinstein and his attorneys could be required to use a specialized booth, according to NBC News.

Weinstein is being held at the L.A. County Jail’s Correctional Treatment Center, a medical unit, during the pendency of his trial on 11 counts of sexual assault and rape. He has been diagnosed with diabetes and sleep apnea and suffers from cardiac and eye issues.

Weinstein has already been sentenced to 23 years in prison in New York after being convicted there in 2020 of third-degree rape and first-degree criminal sexual act, although that conviction is presently under appeal.
