A man from Florida is facing serious charges after allegedly attempting to murder his wife through a series of violent acts. During the assault, he reportedly aimed a gun at her head and pulled the trigger, only to realize the magazine was missing.

The suspect, identified as 67-year-old Fael Francois, has been charged with attempted murder, aggravated assault, and domestic violence battery. The incident, outlined in an arrest affidavit reviewed by Law&Crime, took place on a Friday evening at a residence along NW 114th Street in Miami.

The victim recounted that she was asleep when her husband tried to suffocate her with a pillow, making it difficult for her to breathe. As she managed to get out of bed, Francois allegedly grabbed her arms, violently shook her, and repeatedly slapped her face, according to the affidavit.

After freeing herself once more, she called her sister for help. It was then that Francois allegedly retrieved a gun, aimed it at her head, and reportedly said, “Today, you are going to die,” before pulling the trigger. However, the gun was not loaded, as both the chamber and magazine were empty, preventing any shots from being fired.

“Oh s—, it’s not working,” Francois allegedly exclaimed, according to police reports.

Following this, Francois is accused of striking his wife with an unidentified object, resulting in a cut on her left arm. The victim managed to escape the house and took refuge behind a shed while calling the police for assistance.

Officers responded to the home and arrested Francois. He denied all the allegations against him in an interview with authorities.

As of Monday afternoon, he was in the Miami-Dade County Jail without bond. He does not have a future court date listed. Per the affidavit, he was born in Haiti and works as a security guard.
