Alex Murdaugh Seeks New Evidence Search to Challenge Case

With preparations for a new trial intensifying, Murdaugh’s defense lawyers are pressing prosecutors to take another look at the evidence, arguing that a fresh search could expose weaknesses in the state’s case.

In a filing submitted Wednesday, the defense said the passage of several years since Murdaugh’s first trial makes it necessary for prosecutors to search again for any material that could aid the defense or cast doubt on testimony from the state’s witnesses.

Murdaugh’s attorneys are also seeking records that could be used to challenge witness credibility, including allegations of misconduct, disciplinary actions, conflicting statements, plea agreements, rewards or any promises of leniency or favorable treatment.

The push for a new murder trial of disbarred attorney Alex Murdaugh faces a steep uphill battle after a state judge limited witness questioning and set a high burden of proof surrounding bombshell claims that the court clerk tampered with the jury during last year's hotly-watched proceedings.

The defense request extends to any new forensic or DNA evidence, additional search warrants and records tied to two other South Carolina Law Enforcement Division investigations known as the “Side of Road” case and the narcotics probe.

Murdaugh’s lawyers further asked prosecutors to provide written assurance that they have completed an updated search and turned over all legally required materials.

The defense is asking that the requested information be produced within 30 days.

Murdaugh, once a powerful Lowcountry lawyer from a prominent legal dynasty, was convicted in March 2023 of gunning down his wife and son, Maggie and Paul.

The case was thrown back into turmoil after allegations surfaced that court clerk Rebecca Hill made improper comments to jurors during the trial.

The court found that Hill was drawn by the “siren call of celebrity” and allowed public attention to overcome her duty.

The state has maintained that Murdaugh received a fair trial, but the South Carolina Supreme Court reversed the murder and weapons convictions and remanded the case for new proceedings.

News Outlet has reached out to the state prosecutors’ office for comment. Murdaugh’s defense declined to comment.

Murdaugh is back in court on Friday, Aug. 14.
