California murderer's chilling final words before gunning down innocent woman

A Kern County jury has convicted a convicted felon of murder after prosecutors said a dispute over a stolen motorcycle spiraled into the fatal shooting of an innocent woman.

Luis Villachana, 51, is now facing a potential life sentence for the 2024 killing of 44-year-old Ruth Ann Cummings, who was shot while sitting in her car as she arrived at an Oildale home where Villachana had allegedly threatened to kill her husband and daughter.

According to court documents, Villachana warned, “I’m gonna smoke all you guys,” moments before gunfire erupted.

Prosecutors said the deadly chain of events began the morning of August 29, 2024, after Villachana discovered that a motorcycle had been stolen from his home. Rather than report the theft to law enforcement, the convicted felon allegedly gathered backup and set out to recover the bike himself.

That search eventually brought Villachana and two companions to a residence in Oildale, where authorities said he located the missing motorcycle inside the garage.

Villachana then entered the home and confronted one of the roommates, demanding to know who had taken his motorcycle. When the man did not provide an answer, Villachana attacked him, prosecutors said.

A second roommate was later reached and contacted his parents as the confrontation continued.

Prosecutors said the second roommate’s father came to the home in an effort to defuse the situation, but the confrontation escalated after Villachana allegedly fired at the man’s feet, prompting the father to assault him.

As the man ran from the house, Villachana fired again, striking and injuring him, before opening fire on an SUV driven by Cummings, who had come to rescue her husband, prosecutors said.

Cummings was struck by the gunfire and later died from her wounds.

“Villachana’s actions were avoidable and entirely unjustified,” said Kern County District Attorney Cynthia Zimmer.  

Villachana was arrested in Shafter a little more than a week after the deadly confrontation.

He was convicted Friday of a slew of crimes including first-degree murder, burglary, and attempted murder. He faces up to 50 years to life in prison, plus 24 years and 4 months, at a sentencing set for Aug. 14.
