Fresh allegations involving former Special Counsel Jack Smith are intensifying scrutiny of the investigations he led into Donald Trump’s classified documents and election-related cases.
In the fall of 2025, Smith was accused of violating lawmakers’ rights by secretly subpoenaing their phone records. Earlier in July, Senate Judiciary Committee Chairman Chuck Grassley (R-IA) also alleged that Smith’s team failed to follow classified document handling rules while investigating Trump over similar allegations.
On Tuesday, Grassley leveled another serious claim: Smith’s investigative team allegedly reviewed lawmakers’ electronic communications.
The disclosure is fueling Republican accusations that the Biden-era Department of Justice, led by Attorney General Merrick Garland, used its authority for political purposes. Democrats have repeatedly accused the Trump administration of weaponizing the DOJ, but Grassley’s latest claim is being cited by critics as evidence of similar conduct under Biden.
Grassley said he received records from the DOJ confirming that Jack Smith’s investigative team reviewed the contents of text messages sent by 44 members of Congress, adding that he was one of the lawmakers affected.
He said he is notifying colleagues whose communications were involved and plans to release the records with Sen. Ron Johnson so the public can review the evidence.

For many critics, the claim may sound shocking. At this stage, however, others may argue it is becoming increasingly believable.

Grassley released a statement in conjunction with Senate Investigations Subcommittee Chairman Ron Johnson (R-WI) accusing the tainted prosecutor of bypassing the DOJ’s own safeguards in their quixotic quest:
Special Counsel Jack Smith’s investigative team obtained and reviewed text messages from 44 Members of Congress as part of the Biden Department of Justice’s (DOJ) criminal investigation into President Trump. Evidence shows the investigators bypassed a required Filter Team review process, violating investigative protocols and potentially infringing on constitutional guardrails.
The bombshell discovery comes in new records released today by… [Grassley and Johnson] as part of their ongoing Arctic Frost oversight. Grassley and Johnson requested the records from DOJ after receiving legally protected whistleblower disclosures.
“Jack Smith’s criminal investigation of President Trump was a runaway train that had no brakes,” they wrote.
As you might imagine, those spied on, a group which allegedly includes a handful of Democrats as well as numerous Republicans, were pretty ticked off by the news. Sen. Rand Paul (R-KY) noted that the new information clashes with Smith’s closed-door testimony under oath to Congress in December ‘25:

The longer that Joe Biden is mercifully away from the Oval Office, the more apparent the destruction his administration brought becomes. From the tens of millions of illegal aliens he ushered over our borders, to his attempts to kneecap our energy supplies, to his radical gender agenda, and, as we keep learning, to his apparent willingness to look the other way regarding corruption in the DOJ, it’s all a stark reminder of what we’ll see again if Democrats take power.
For Smith, his reputation just keeps slipping further down the drain.
