Irvine police are seeking the public’s assistance in identifying a man suspected of following a woman inside a California supermarket and allegedly taking a secret “upskirt” photograph.
The Irvine Police Department said the incident occurred at the H-Mart located near Alton Parkway and Culver Drive. According to investigators, the man followed a female shopper through the store before allegedly photographing her without her knowledge.
Authorities shared details of the case Wednesday, Oct. 7, through the department’s #WantedWednesday outreach campaign, asking anyone who recognizes the suspect to come forward.
Police have not released the man’s identity, and no criminal charges have been announced. Investigators also have not provided an exact date for the alleged incident, saying only that it happened recently.
The allegation has raised concerns because customers should be able to shop without fear of being secretly photographed beneath their clothing. At this stage, however, investigators must still verify the circumstances, identify the person involved and determine whether the available evidence supports criminal charges.
California Penal Code Section 647(j)(2) covers certain instances in which someone secretly photographs or records another person under or through their clothing without consent, provided the legal requirements of the statute are met.

A misdemeanor conviction for a first offense may carry a sentence of up to six months in county jail and a fine of as much as $1,000.
Those potential penalties do not represent a sentence in this investigation. Irvine police have not announced a charge or said that the unidentified man has been arrested.
Whether the suspect could face criminal liability will depend on the evidence gathered and the law that applies to the alleged conduct.
Authorities have not disclosed whether the photograph was shared with anyone, nor have they said whether the man may be connected to other reported incidents.
