Florida hospital sues to evict patient who refuses to leave for months

A hospital in Florida has taken legal action against a former patient who has allegedly overstayed her welcome for five months, despite being medically cleared for discharge. Tallahassee Memorial HealthCare (TMH) claims the woman, who was officially discharged on October 6, 2025, continues to occupy a room meant for other patients in need.

The issue has escalated to the point where TMH has filed a lawsuit, citing that the woman’s extended stay is straining their already limited resources. According to the complaint, obtained by the Tallahassee Democrat, hospital staff have made numerous efforts to assist the woman in leaving safely. These efforts included coordinating with her family and arranging non-emergency medical transportation to help her obtain necessary identification.

Hospital officials express concern that the prolonged occupation of the inpatient bed is severely impacting their ability to provide care to other patients who require acute medical attention. “TMH has limited inpatient beds,” the complaint emphasizes, pointing out that the woman’s continued presence is preventing the hospital from offering care to others in need.

The situation highlights the challenges healthcare facilities face when dealing with non-compliant patients, especially in terms of resource allocation and patient care priorities. It remains to be seen how the lawsuit will unfold and whether it will prompt the former patient to vacate the hospital room she has held onto for so long.

“TMH has limited inpatient beds,” the complaint states. “The defendant’s continued occupancy prevents use of the bed for patients needing acute care.”

Despite its efforts, the woman remained in the hospital as of March, according to the filing.

TMH is now seeking a court order requiring her to leave and authorizing the Leon County Sheriff’s Office to assist in removing her if necessary.

A hearing is scheduled for March 30.

It is unclear how often hospitals resort to legal action to remove patients who refuse to leave after discharge.

TMH told Fox News Digital in an email requesting comment on the matter that “TMH is not able to discuss active legal matters, including background details.”
