Breaking: 9th Circuit Issues Stay Pending Appeal in CA National Guard Case, Handing Trump a Big Win

It seems that California Governor Gavin Newsom will have a less-than-pleasant evening as the 9th Circuit Court of Appeals made a decision on the Trump administration’s application for a stay during appeal. The court approved the motion, which grants the federal government temporary control over the National Guard.

The situation began when President Trump issued an order to federalize the National Guard following unrest triggered by protests related to immigration raids in the Los Angeles area. In response, Newsom took legal action by filing a lawsuit to counter the federal move, opting to submit the case in the Northern District of California instead of the Central District where Los Angeles is located. A temporary restraining order (TRO) from Judge Charles Breyer initially returned control of the Guard to the state. 

Nevertheless, just hours after this decision, a three-judge panel from the 9th Circuit Court of Appeals issued an administrative stay after the federal government’s appeal.
