'Smogdog'  gym boss on Aussie holiday isle is charged with rape

A Melbourne personal trainer and cocktail-bar operator with strong local connections, who relocated to a South Australian holiday island following his divorce, has been charged with rape.

Kenneth Paul Smoglian, 39, a former boxer and the owner of Island Fitness in Kingscote on Kangaroo Island, appeared before Adelaide Magistrates Court last week charged with one count of assault, one count of indecent assault and one count of sexual intercourse without consent.

Smoglian, who has not yet entered a plea, spoke over proceedings to request bail, prompting an immediate reprimand from Chief Judge Mary-Louise Hribal.

Court documents viewed by the Daily Mail state that police allege the incidents occurred across two days in American River, a small coastal community located between Kingscote and Penneshaw on Kangaroo Island.

On June 12, Smoglian, who uses the nickname Smogdog online, is accused of indecently assaulting a woman by touching her buttocks.

Police further allege that on June 13 he assaulted and raped the same woman.

According to the court filings, Smoglian allegedly “had sexual intercourse without [her] consent,” while knowing she was not consenting “or being recklessly indifferent” to whether she had consented.

The documents describe the allegation as “a major indictable offence.”

Smoglian’s legal team asked the court to allow him to be bailed to his home address on the island, 110km south-west of Adelaide.

‘Originally, we sought home detention bail but were advised that DCS [Department for Correctional Services] cannot monitor home detention on Kangaroo Island,’ she said.

‘He’s not originally from SA, he has no family support on the mainland, and his business is going into financial decline with him in custody.’

Police opposed bail because of their ‘significant concern’ that Smoglian may cross paths with the alleged victim.

According to the Adelaide Advertiser, Smoglian then raised his hand and interrupted, saying: ‘I’m happy to stay away from [her location] if you deem me eligible’.

Judge Hribal warned Smoglian to speak ‘through his lawyer’. 

She ordered a bail inquiry report and remanded him in custody until later this week.

Smoglian revealed in local media that he’d moved to Kangaroo Island after going through a divorce.

In June 2017, he married Melbourne woman Jessica Hazell – but it appeared the union was short-lived.

Ms Hazell appears to have remarried.

She was by his side when he opened Envy cocktail bar in Croydon, 30km east of the Melbourne CBD. 

According to Smoglian’s social media, he sold the bar in 2018. 

‘Unfortunately the business took a toll on my personal life, as I ended up putting a lot of stress on my marriage, which led to a divorce, and the start of my early life crisis,’ he revealed on social media.

‘I decided to sell the bar, move to Kangaroo Island and start fresh.

‘Reflecting on my past, I am glad I went through those tough times because it’s made me who I am today.’

The former professional boxer also worked as a personal trainer at East End Boxing, a gym in Croydon.

Daily Mail can reveal Smoglian was friends with Aussie two-time world boxing champion and Commonwealth Games gold medallist Andrew ‘The Monster’ Moloney.

In a 2017 post, Smoglian posed with his arm around Moloney and said: ‘Congratulations to my best mate @andrewmoloney on becoming the first ever Australian boxer to win the Commonwealth Games  gold medal as well as the Commonwealth title. Legend.’

Moloney, who was born in Mitcham in Victoria, has held the IBF super-flyweight title since June.

Smoglian moved to Adelaide around 2019, where he worked at trendy pub The Moseley Bar and Kitchen in Glenelg.

He frequently posted pictures from the venue’s beach club.

The Moseley was backed by former AFL stars, Port Adelaide’s Travis Boak and Robbie Gray, and Adelaide’s Ben Rutten.

After moving to Kangaroo Island around 2021, Smoglian launched Island Fitness.

‘Originally I was going to open up another bar and have it based in American River,’ he said.

‘But then another business popped up just at the right time and I committed to make a go at this.

‘I came from making profits by serving people alcohol, and now I am making people a healthier and better version of themselves,’ he said.

‘I have the best job in the world.’
