What to expect when Lindsay Clancy returns to court after mistrial

Lindsay Clancy is scheduled to appear in court again on Sept. 29, weeks after a judge declared a mistrial in her Massachusetts murder case on Sept. 4.

Katherine Loftus, a legal analyst who is not connected to the case, told Oxygen exclusively that the next hearing will likely focus on how prosecutors intend to proceed.

According to Loftus, the court is expected to address a new trial timeline and clarify the Commonwealth’s position on the charges. She said prosecutors are highly likely to retry the case, though there could be discussion about whether they continue pursuing first-degree murder charges or seek a reduction to second-degree murder. The Sept. 29 hearing, she explained, will likely determine what charges move forward and when a new trial date will be set.

The upcoming court date follows the mistrial ruling, which temporarily halted proceedings but did not end the case. Loftus said that, in the meantime, Clancy is expected to remain in a mental health facility.

Loftus explained that Clancy’s existing bail conditions remain in effect. In Massachusetts, defendants facing first-degree murder charges are held without bail, meaning Clancy remains in state custody. She is currently being held at Tewksbury Hospital, a state mental health facility, rather than a house of correction, and is expected to stay under the Commonwealth’s custody until another trial takes place.

What Was Lindsay Clancy Accused Of?

Clancy’s murder trial centered on the deaths of her three children on Jan. 24, 2023, inside the family’s home in Duxbury, Massachusetts. She has acknowledged killing 5-year-old Cora, 3-year-old Dawson and 8-month-old Callan, the children she shared with her husband, Patrick Clancy.

Patrick testified that Lindsay asked him that evening to go to a nearby CVS to pick up medication and then stop at a local restaurant for takeout. When he returned, he found her in the backyard after she had jumped from a second-story window in an apparent suicide attempt. Inside the basement, he discovered Cora, Dawson and Callan strangled with exercise bands. All three children died from the attack.

In their opening statement, the prosecution argued that during the time frame that Patrick was out of the house, Lindsay executed the children’s killings with “deliberate premeditation and extreme atrocity and cruelty.”

“This was not a woman in the throes of psychosis on Jan. 24, 2023,” Plymouth County Assistant District Attorney Shanan Buckingham told jurors. “This was a woman who acted intentionally, rationally and swiftly to accomplish a very specific goal: to kill.”

“This was a woman who no longer liked the life she thought she wanted,” she added. “It was getting harder and harder to control, and when she saw the opportunity to escape, she made the selfish choice to take it, and to take Cora, Dawson and Callan first before attempting to take her own life.”

What Was Lindsay Clancy’s Defense?

Lindsay’s defense attorney Kevin Reddington did not dispute she killed the children, but he argued that her actions were driven by postpartum psychosis, not malice, and that she was therefore unable to understand the wrongfulness of them.

“This is a woman that was suffering from psychosis at the time that she went down to that basement,” he told jurors during his opening statement. “She had no motive. She loved her children. She intended to kill herself. She didn’t fake that.”
