Alternative cause of death can't be 'ruled out' for Luke Davies

The court was shown CT scans of Jesse Baird’s head taken after he was allegedly shot dead.

Radiologist Dr James Raleigh said the scans showed severe damage to the right temple, where a bullet was likely to have entered the skull.

He said a second wound on the left side of Baird’s temple was likely the bullet’s exit point.

The scans also showed displaced teeth, indicating that a bullet may have entered through Baird’s jaw.

The court also heard detailed evidence from forensic pathologist Dr Kendall Bailey, who conducted the post-mortem examinations of Baird and Luke Davies, pictured.

Dr Bailey outlined the locations where bullets entered and exited both men’s bodies.

Baird was allegedly shot through the top of his right shoulder, with the bullet passing through his body before exiting through his chin.

The bullet missed his major arteries and windpipe and was not, in itself, fatal, the court heard.

Dr Bailey described the wound as “very nasty” but said it could have been survived with medical treatment.

“A person who sustained an injury like that may be incapacitated; bony injuries are very painful,” she said.

Another bullet travelled through one side of Baird’s head and exited through the other.

Dr Bailey said she could not establish the full extent of the brain damage caused by the second bullet because Baird’s brain had been “liquefied” by the time his body reached the autopsy table.

She said the bullet may not have killed Baird instantly because it did not strike his brain stem, although it would have immediately incapacitated him.

The court heard that someone with a brain injury of that nature would not have been able to consciously throw a gun across a room.

Dr Bailey also said Davies had suffered a severe neck injury and was allegedly stabbed twice in the right thigh after his death.

The thigh wounds were inflicted with a “single-bladed instrument” but did not bleed. Dr Bailey said this could indicate they occurred after death, when the heart was no longer pumping blood through the body.

Similar sharp defects were found on the surfboard bag that covered Davies’ body, she said.

Davies had a gunshot wound that entered his head just above the left eye and exited through the back of his head.

Dr Bailey said the injury may not have been instantly fatal, but it would have immediately incapacitated Davies, who would have died soon afterwards.

His cause of death was recorded as a gunshot wound to the head, although Dr Bailey said she could not rule out the severe neck injury as a contributing cause.

Davies was not shot in the neck, but she said the injury would have constricted his jaw and he may have choked back blood.

No drugs were detected in his system. An alcohol analysis could not be completed.

Ballistics expert Lucas Van Der Walt took the court through the mechanics of Beau Lamare-Condon’s police-issued firearm (pictured) in detail.

Jurors were shown a replica gun that has the same dimensions as the alleged murder weapon, but cannot be fired.

Mr Van Der Walt demonstrated how to load and shoot the gun.
