Harvey Weinstein avoids fourth New York trial over alleged actress rape

Harvey Weinstein will not be tried again on allegations that he raped actress Jessica Mann in 2013, after Mann said she could no longer endure the emotional toll of testifying in court.

“It was clear to me at this last trial, I can no longer go through this,” Mann, 40, wrote in a letter that was read aloud Thursday morning during a hearing in Manhattan Supreme Court.

Reflecting on her time on the witness stand, Mann added, “It has put me through more harm than good.”

The Manhattan District Attorney’s Office declined to pursue another retrial after a jury in May failed for a second time to reach a unanimous verdict on Mann’s allegations against the disgraced 74-year-old former Miramax boss.

“To be clear, we believe Ms. Mann’s account and her credibility as a witness,” Manhattan DA Alvin Bragg said in a statement following the decision.

“This has been an extraordinarily taxing ordeal for her, and she has never wavered while testifying in front of two grand juries and three trial juries over the course of eight years. We thank her for her honesty and her tremendous bravery.”

Weinstein, who remains held without bail on Rikers Island, still faces up to 25 years in prison at his Sept. 23 sentencing on a separate conviction for sexually assaulting Miriam “Mimi” Haley, a former TV production assistant.
